working draft — legal operator, jurisdiction and counsel review required before launch
terms
Rush is for entertainment, creative expression and social play only. It does not provide medical, mental-health, legal, financial, safety, relationship, educational, professional or other advice. Do not rely on a Drop, a model output, a score, a result card, a creator or another user when making a real-world decision.
By using Rush, you agree that outputs can be wrong, incomplete, offensive or unavailable. You are responsible for how you use them and for checking anything important with a qualified professional. If you have an emergency, contact local emergency services or a qualified provider instead of Rush.
using Rush
You must be at least 13 to publish and use Rush only where you may legally do so. Do not use it to harm people, break the law, impersonate someone, invade privacy, distribute malware, scrape the service, manipulate engagement, evade limits or create unlawful, deceptive, hateful, sexually exploitative or infringing content.
We may investigate, limit, remove, hold or report content or accounts when we believe that is needed to protect people, the service or our rights. We do not promise to review every Drop, result, message or external app, and we do not guarantee any ranking, reach, availability or preservation of content.
your content and remixes
You keep the rights you have in content you submit. You give Rush a worldwide, non-exclusive, royalty-free license to host, reproduce, adapt for technical delivery, display, distribute and promote that content through Rush while it is available on the service. You confirm that you have the rights and permissions needed for that use.
A public Drop may be remixed under the remix setting shown for it. Rush records ancestry and attribution, but it cannot decide ownership disputes between creators. Do not publish material that infringes another person's rights. Send copyright or other rights complaints to team@therush.fun.
hosted apps and external links
A hosted app runs on its creator's website or opens from Rush to that website. The creator, not Rush, controls that service, its data practices, sign-in, content, availability, claims and transactions. A listing, attribution link, like, ranking or user result does not mean Rush has tested, endorsed or guaranteed the external app.
Creators must make any paid, gifted, affiliate or other material connection clear and conspicuous wherever they promote an app or recommendation. An optional “Try this app on Rush” link only identifies the app's Rush page; it is not a paid endorsement or a claim about the app.
disclaimers and limits
To the fullest extent allowed by law, Rush is provided “as is” and “as available.” We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, security and uninterrupted service. To the fullest extent allowed by law, Rush and its operators, contributors and providers are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for loss arising from content, outputs, hosted apps, external sites, data loss or service interruption.
Where the law permits, you agree to defend and indemnify Rush and its operators against claims arising from your content, your hosted app, your misuse of the service or your breach of these terms. Nothing here removes rights that cannot lawfully be removed.
changes and contact
We may change, suspend or discontinue parts of Rush and update these terms. Material changes will be posted here with a new effective date. Questions, notices and reports go to team@therush.fun.
Before public launch, replace this working draft with counsel-reviewed terms that identify the legal operator, effective date, governing law, dispute process, payment/refund terms if applicable, and a designated copyright agent if you want U.S. DMCA safe-harbor treatment.
